DISCLAIMER: Bear in mind that these are unproven allegations filed in a United States District Court Civil Case.
EDIT: Everyone is entitled to their opinion. I am neither assuming that these claims are either absolutely false with 100% certainty, nor the opposite (or anything in between :-)
Kali Holloway of Alternet broke this story in detail (although the Daily News covered it in a more cursory manner).
Case No: 1:16-cv-04642 6/20/16
US Dist. Ct. SDNY
Defendants: Donald J. Trump & Jeffery E. Epstein
Complaint for: RAPE, SEXUAL MISCONDUCT, CRIMINAL SEXUAL ACTS, SEXUAL ABUSE, FORCIBLE TOUCHING, ASSAULT, BATTERY, INTENTIONAL AND RECKLESS INFLICTION OF EMOTIONAL DISTRESS, DURESS, FALSE IMPRISONMENT, AND DEFAMATION
There are several different parts to the
complaint, filed anonymously by the
plaintiff.
- Plaintiff alleges that she, a minor of 13 at the time (1994), was lured to defendant Epstein's mansion on several occasions by promises of various sorts (including monetary compensation (although not apparently for sexual acts), and a possible modelling career.
- Plaintiff alleges that she was tied to a bed and forcibly raped by Defendant Trump, despite her repeated requests for the behavior in question to cease.
- Plaintiff alleges that her requests were met by physical battery on the part of Defendant Trump, namely by “violently striking Plaintiff in the face with his open hand, and screaming that he could do whatever he wanted” (this is a direct quote from item #10 of the complaint, supported by affidavits).
- Plaintiff additionally claims that “Immediately following the rape, Defendant Trump that, were she ever to reveal any of the details of the sexual abuse of her by Defendant Trump, Plaintiff and her family would be physically harmed if not killed.” (from #11 of the complaint, supported by affidavits.)
- Plaintiff alleges suffering from “stress, emotional distress, mental pain and suffering among other problems” (from #13 of the complaint).
I haven’t included the affidavits (exhibits A and B which you can see right here [EDIT: the filing attorney’s info. is also available, I didn’t capture everything, I just tried to stick to the pleadings.]
If you want the PDFs broken down, go here and look for Doe v. Trump et al).
But it turns out that the case was originally filed in CA, and P alleges
being threatened after doing so.
It’s also interesting to observe that there is an affidavit from an (also unnamed) witness who claims to have been an employee of Epstein’s (22 y.o. at the time), who was hired to assist with these “parties.”
Kali Holloway’s excellent original piece in Alternet also provides some good background on Jeffery E. Epstein.
You might also want to keep three things in mind about this case:
- There is every chance that further proceedings could be delayed until after the election, even assuming that it’s not dismissed due to the Statute of Limitations.
- P argues that the Statute was “tolled” by threats of coercion, so it’s not even clear that a hearing on the almost-certain motion to dismiss will occur. (I’m not even sure if a jury can find that particular fact, although maybe.)
- There are additional claims against Epstein.
- Somebody in the comments pointed out that the $75 of damages makes it look like a scam. Not so, that’s the minimal amount for “diversity jurisdiction” … they can always raise it later. This is an initial complaint which can be amended.
- Somebody in the comments wanted to know who filed the case:
s/ Thomas Francis Meagher
Thomas Francis Meagher
SDNY Bar Code TM6707
One Palmer Square Princeton,
New Jersey 08542
- Yes, this case was originally filed by the plaintiff in CA (w/o the assistance of counsel). From Kali Holloway’s piece: The lawsuit was originally filed in a California court. At the time, Jane Doe—who used her real name—did not have the aid of counsel in filing and the suit was dismissed due to problems with paperwork. Doe's new lawyer, Thomas Meagher, told the Daily News the first filing also “cited statutes that did not apply to the case.”
