Yesterday US Immigration and Customs Enforcement issued the first of its new, weekly Honor Rolls of Jurisdictions that refused to violate immigrant rights.
No, seriously, they did. They call it the “Declined Detainer Outcome Report.”
This report lists all the cases where local officials have refused to honor ICE’s requests to hold immigrants in custody who would otherwise be released without charges or a warrant. The list shows that most such persons were convicted of a crime at some point in the past. The fact that they were released indicates that they have completed their sentences and that the government declined to deport them at that time (does deporting someone for a crime after time was already served count as Double Jeopardy under the 5th Amendment?). Others on the list are simply accused of a crime. The crimes themselves range from DUI to Kidnapping and Assault.
The report also lists all the jurisdictions know to ICE to have policies of not cooperating with ICE. The vast majority of those jurisdictions have a very extreme policy like this one from Wallowa County, Oregon:
Will not honor ICE detainer without court order or warrant
I, for one, would like to thank these jurisdictions for protecting the rights of immigrants under the 4th and 5th Amendments to the US Constitution.
