Yo, MAGA!
What happened in CO wasn't a trial. It was a legal assessment of eligibility based on 14th Amendment Section 3 criteria; the provision is self-executing.
Besides, no amount of legal sophistry would convince anyone with a working brain that the Presidential role is not a governmental office. He's the head of the military; he's the head of the Executive Branch. Section 3 calls people in those positions “officers.”
For the love of god, read Section 3 of the 14th Amendment yourselves.
(my 2-minute video summation)
Heck, even some Republican scholars, like J. Michael Luttig, agree with the Colorado Ruling, calling it unassailable. Trump does not have to be convicted of the crime of insurrection to be removed, either.
Yes, that is correct as a matter of constitutional law. In fact, Section 3 of the 14th Amendment is self-executing, which means that congressional action is not required. Nor is it required that the former president be convicted of the criminal offense of an insurrection or rebellion against the United States under Title 18 USC 2383. — POLITICO
The Death cult’s looming caucus threats
To no one’s surprise, MAGA folks freaked the hell out over the Colorado Supreme Court’s decision, acting as if Trump being kicked off a ballot in Colorado, a state he was unlikely to win anyway, was akin to asking the man to walk the plank into shark-infested waters (Please, Santa, please?)
The Seven Colorado Justices in the case were met with violent threats from MAGA terrorists, guttural cries of “off with their heads” arising from the brain-dead riff-raff that populates the town of Loserville.
A report compiled by Advance Democracy, a non-partisan non-profit organization, said there was “significant violent rhetoric” against the justices and Democrats on social media, according to NBC News.
Some of the worst of it was posted on fringe websites, including one post that said “behead judges” and “slam dunk a judge’s baby into the trash can”.
Another post on The Donald, a pro-Trump forum where a Trump supporter once publicly bragged about his involvement with the January 6 insurrection and was arrested as a result, said “this ends when we kill these fuckers”. —The Guardian
Mixed within the howling hullabaloo was the Colorado GOP tantrum chant of CAUCUS, which I am highly amused by.
You want to put a guy on your ticket who could be in jail in a few months and who is credibly accused of insurrection?
Oh—don’t let me stop you. Please—proceed.
Let the voters decide?
Interesting, as no Republican beat upon their breast when The Supreme Court decided Bush v. Gore—but I digress. This admonishment is rich and somewhat hollow, especially coming from the side that had an entire insurrection to overthrow the people's will.
Now, depending on what SCOTUS decides, the question of Trump’s political viability may be moot. In this regard, I hope the conservative court justices do the right thing and ensure Trump can’t be on any ballot anywhere in the United States because, yah know, Constitution.
Not holding my breath.
