The position I am taking in regard to Trump’s being on the ballot in 2024 is going to be very unpopular with many, but I have a good Constitutional reason to take this position. Yes, Trump should be on the ballot at this time, but there is a silver lining for those who might be disappointed if Trump is on the ballot. The California SoS has decided to keep Trump on the ballot at this time for the same reason.....… It’s called due process.
There is absolutely no doubt in my mind that Donald Trump has committed insurrection, and belongs in prison cell instead of the Oval Office. However, according to our Constitution, this Nazi wannabe is still innocent until proven guilty in a court of law, either criminally by showing that no reasonable doubt exists that Trump committed insurrection, or civilly by showing through a preponderance of the evidence that Trump committed insurrection. Until either of those 2 results happens, Trump is innocent. I might not like it, but it is what it is. So here’s what will happen, and I strongly believe that it will…..
1- The good news: Trump will be convicted sometime next year, either criminally or civilly, of insurrection, and will be removed from the ballot in all 50 states. Constitutionally, this will be proper. Politically, it will be a disaster for the GOP, as they scramble to find his replacement, while showing Independents their hypocrisy. Democrats will win by a landslide.
2- The better news: Trump will be convicted, but the Federal government will not intervene while some states remove him from the ballot and others keep him on, with the result being that Trump runs while at the same time filing lawsuits against the states that remove him from the ballot. All this dirty laundry being exposed to sunlight means that the Democrats will win by a landslide.
3- The best news: Trump manages to delay his trials past the election, and the Supreme Court rules that he cannot be removed from the ballot without due process. We of course know that those right wing Heritage Foundation justices will vote to keep him on the ballot because for them it’s about politics. However, the Liberal bloc of justices will also vote to keep him on the ballot because for them it’s about upholding the Constitution. Democrats will not only win by a landslide, but Trump will be the albatross that takes down the GOP for at least a generation.
So, to everybody who is reveling in Trump being kicked off the ballot in Colorado and Maine, please don’t. Republicans do this, we don’t need to. As the legal process and the political fallout proceeds, the truth about Republicans is setting us free. That’s all we need. In a country that has lots of Republicans, be a Democrat. 2024 is going to be a great year for us.
