The Supreme Court is scheduled to hear oral arguments on February 8, on whether or not Trump should be disqualified from holding the office of President and removed from the ballot pursuant to Sec. 3 of the 14th Amendment. The legal arguments for removing him are strong, and are backed by a number of conservative legal experts, including Judge Luttig.
In addition, with respect to the question of whether or not Trump engaged in an insurrection, we must remember a majority of the House voted to impeach him for engaging in an insurrection in connection with the events of 1/6/21, and a majority of the Senate voted to remove him from office. Thus, majorities in both the House and Senate have determined that he engaged in an insurrection. The fact that the Senate did not reach the 2/3 threshold for removal is not an acquittal, and is irrelevant.
Additionally, the January 6, Special Committee, determined he engaged in an insurrection, and referred the issue to the DOJ to determine if criminal charges for insurrection should be brought. The fact that Jack Smith exercised his prosecutorial discretion and did seek an indictment for insurrection is also irrelevant.
Moreover, there is nothing in the Constitution that an insurrectionist must be convicted in a criminal proceeding before he can be disqualified from holding public office. The Supreme Court has jurisdiction to determine what the Constitution means. It does not have jurisdiction to amend the Constitution by adding requirements that are area not in the Constitution, like a requirement that there be a prior criminal conviction.
The Conservative Supreme Court may realize that the Republican Party will have a better chance of defeating Biden in November, with a Haley/Biden race instead of a Biden/Trump rematch. Most importantly, they may realize that our Democracy would be better served if a Dictator is not given an opportunity to be elected President. After all, Supreme Court Justices take an oath to support the Constitution, not Trump.
Now we have to get the word out so the Supreme Court clearly understands they have the power to ensure that our country remains a Democracy, and not a Dictatorship which would undermine the independence of the Court, itself.
Of course, we all have to continue working to ensure that President Biden is re-elected, and the Democrats regain control of the House, and maintain control of the Senate.
