SCOTUS may take up Trump’s appeal of the decision. but allow things to start back up at the trial level, and toss a hint that’s exactly what they think judge Chutkan should do. But if they grant a stay pending an appeal, even on an “expedited” basis we are looking at a couple of months (at best) delay. Maybe, probably more. And that will be that. No Trump trial in DC before the election.

“This application is déjà vu all over again,” the former president’s lawyers write, noting that special counsel Jack Smith had tried and failed to get the nine justices to decide the question on a fast-track basis in December.
But another of the late and revered New York Yankees catcher’s phrases offers a better summation of Trump’s interminable delay-at-all-costs legal strategy designed to defer a reckoning until after November’s election — “It ain’t over till it’s over.”
The ex-president asked the Supreme Court on Monday to step in to temporarily block a US Court of Appeals decision that last week eviscerated his claims that a president is effectively above the law while in office and shielded from prosecution afterwards.
The filing is Trumpian in its audacity.

But the resistance must be about more than Trump. The democratic energies we expressed in the years and months leading up to November 2016 must lead to a struggle for democracy, which means a sustained struggle against the authoritarianism of both Trump and the reactionary forces that enabled his rise to power and authority. We must resist the future now taking shape in the fevered imagination of those like chief White House strategist Steve Bannon, who once openly admitted to emulating Lenin in wanting to “destroy the state” and wants to push us further and further to the right.
The die is cast. To secure American democratic life, we must resist and overcome not only the initiatives of the greedy, corrupt, bigoted and narcissistic bully who currently occupies the White House, but also the anti-democratic ambitions and schemes of corporate capital and the right. If our parents and grandparents’ lives tell us anything, it is that it’s not just a matter of rejecting authoritarianism but of acting in solidarity to radically enhance freedom, equality and democracy.
