Today, 70% of Kansas' voting citizens decided to amend their state constitution to include a ban on gay marriage and civil unions. The amendment does so by limiting the "rights and incidences" of marriage to unions of only one man and one woman.
However, even the ban's supporters believe that it will be defeated in the courts. Most likely, this will occur in federal court, since state courts in Kansas have a long-standing tradition of supporting "traditional" marriage and the above definition has been codified in the law in Kansas since 1867.
The ban may impact powers of attorneys, living wills, trusts, and even health benefits for both gays and unmarried heterosexuals.

Kansas becomes the 13th state in the last year to pass such an amendment. Such activity has spurred proponents of a national Constitutional amendment to ban gay marriage, so that state amendments will withstand the decisions of the federal judiciary. The fight, it appears, is just beginning.
