As if there were not reasons enough to support Senator Russ Feingold's resolution calling for the censure of President Bush for his deliberate vioation of FISA, Andrew Sullivan's opposition to it and his belief that this "saves" the Bush Administration has to be the clincher. Forget that Sully has been wrong about everything for at least 10 years, Sully's hypocrisy is enough.

The question, of course, is whether brazen perjury and obstruction of justice were sufficient for impeachment. Here, Posner concedes that the issue is far more complicated. He rightly, in my view, believes the independent counsel law to have been bad law, and is a fierce critic of the Supreme Court's perverse 1997 decision in Clinton v. Jones, which allowed Paula Jones's suit to go forward while Clinton was in office. He is also a skeptic about the scope of sexual harassment law. But given the fact that these laws exist, Posner credibly shows how Clinton's offenses were clearly within the realm of offenses that could be held to be impeachable. Impeachment, in other words, was in no measure a constitutional ''coup,'' as some Clinton apologists absurdly argued. Clinton's conduct -- not Kenneth Starr's excessive ''zeal'' -- put the possibility in play. Posner effectively dispenses with the notion that some other public figure -- like a mayor or governor -- would never have triggered the same sort of prosecutorial energy, and suggests that in a criminal trial a person who had done what President Clinton had done would have received ''a prison sentence of 30 to 37 months.'' Not the most serious offense in the world, but surely serious enough.
Richard Posner is full of shit by the way. I am a practicing trial attorney and have been involved in hundreds of depositions. In very few of these has the witness not lied on some issue or other. As for "obstruction of justice," I suggest Posner review the concept of "spoliation" - which is a nice word for obstruction of justice in civil cases. Sully too is just so full of shit. But wait, see how serious lying about a consensual blow job is?

The only way the GOP base will be motivated to vote for an incompetent, exhausted, fiscally insane administration is if they get to vote against "libruls". Michael Moore, the Daily Kos, Paul Krugman, George Clooney, et al. are therefore the GOP's last, best hope this fall. Feingold's call for censuring the president is the best thing to happen to Bush for a long time. Hillary will help, whatever she actually does. The question is merely whether the anti-left card will work any more. It barely did the trick last time - in a buoyant economy, in wartime, against a candidate as pathetic as Kerry, Bush could have lost if a few thousand votes in Ohio hadn't been beaten out of the anti-gay scrub. My gut predicts a huge swing against the GOP this fall. So watch out for the anti-left hate and hysteria from Republicans. It's coming. It's all they've got left.
