When the GOP took control of the Colorado legislature they tried to overturn the districts set in 2002 (a la Texas), arguing that since they had been set by a court (the legislature missed a deadline) they had the right to redo them rather than wait until the regular decennial redistricting due in 2010. The Supreme Court today declined to hear the case, thereby upholding the districts.
An interesting dissent was filed by the usual suspects (rehnquist, Scalia and Thomas)
