Why hasn't one very real scenario of Fitzgerald's case been discussed so far?
Is he really just after Judy Miller of the Times as the fall-girl.
She would be a perfect way to prove he's out for a conviction, satisfy the letter of any law broken, and exonerate the administration from responsibility.
It looks as though he's going for a contempt charge and the threat of real prison time despite her willingness to sacrifice all for the sake of honor and Journalism, so one might conclude the pursuit to out her sources is a lost cause.

If she in fact delivered information to the WH (at least was manipulated to think she had the original source of the CIA connection) then communicated that to other reporters, the whole wierd circle can be drawn around her neck.
Giving up her source (State Dept. Memo leaked to another reporter not as yet named or found) would not excuse her from charges.
Miller probably informed Novak, Novak probed Rove, then Novak cooperated with the investigation and gave up Miller. Miller discovers the treachery and the set-up and figures she has no choice but to refuse to name her own source: some other clueless toad reporter planted with the leak.
This seems so simple a solution to the problem that just might be what Fitzgerald is after. Not Rove or the WH but Miller.
But whoever that toad reporter was will never be found.
