Do you believe that Florida's application of its state election laws in its administration of the 2000 election presented a federal issue?
That is the question I most want John Roberts to answer. We must not forget that the single most egregious act of judicial overreach by the Supreme Court of the last 50 years was the Supreme Court's desperate attempt to rationalize its decision to stop the Florida recount and hand the election to George W. Bush.
It is one thing to have a certain philosophy and stand for it. The conservatives on the Supreme Court--including Sandra Day O'Connor--put their partisanship above states' rights because it served their party's interests. The Supreme Court revealed much about itself with that decision. I think it would be pertinent to know if Judge Roberts would join the conservative Justices in putting politics above the law.
His answer to that one question would tell the Senate everything it needs to know about how he will decide all of the major issues.
