As some of us are surely aware, today the
Ninth Circuit and the Second Circuit handed down opinions ruling the Federal Partial-Birth Abortion Act (FPBAA) unconstitutional. Soon enough the SCOTUS will address the constitutionality of this act, and, if he sticks with his usual opinions on abortion cases, Justice Scalia should rule the law unconstitutional. He has consistently said abortion should be left to the States. If I am correct, I can't wait to see the reaction on the far right. Those who don't understand the rationale will assume he has turned against abortion. That should be very entertaining.
