New Report Finds Bush Banned Rights Before Military Tribunal Law Enacted by Congress by Patriot Daily News Clearinghouse.
Why is this important? Because it highlights a big loophole in Senator Dodd's attempts to amend the Military Commissions Act.
One is subject to trial for war crimes only if one is an "unlawful enemy combatant." For current detainees, that determination has already been made, and the Seton Hall report addressed in the diary concludes that those proceedings were a "total sham," and "devoid of legal rights."
The amendments to the Military Commissions Act proposed by Senator Dodd do not provide for review of these unfair proceedings. All detainees currently held as "enemy combatants" will continue to be subject to trial for war crimes, despite never having been afforded due process and a meaningful opportunity to challenge their status as such.
