There are two very important points which have been lost in the Soloman Amendment discussion:
- Law Schools that take no money from the federal government are still forced to allow military recruiting because the Soloman Amendment will cut off funding to the entire University. Law School gets 0 dollars, University gets 2billion... The idea that the law schools could simply refuse funding is a red herring.
- Private firms that discriminate are still legally barred from recruiting at these law schools. Historically, law schools have used their anti-discrimination policies to help open up the legal profession to women, minorities and homosexuals. The Soloman Amendment is simply a way for the military to avoid playing by the same rules as everyone else.
