I'm no lawyer, but I've thought about this for a long time (30 years).
How about:
"Only parties to a transaction may originate, transport, view, receive, record and retain electronic representations of the transaction. Retention may not exceed the warranty period, or 7 years, whichever comes first."
This seems more important than whether gay lovers marry.
This kind of law would force companies to get rid of their old records about you. It would also outlaw collection of data by credit scoring agencies and others who feed off the data they collect about you, to which they really have no legal right to have.
Just think about the reduction in junk mail alone. Not to mention clarifying what the US Government can/can not retain. They would still be able to keep tax records, SSA records, etc. They would NOT have legal basis for my cell records, credit card transactions, health transaction records, etc.
Feel free to suggest better language, but the general idea should remain the same. Clarify the 4th Amendment in NO UNCERTAIN TERMS. Something even Scalia can apply constructionist logic to without question.
