Washington DC: In a landmark decision the Supreme Court today declared the 14th Amendment to be unconstitutional. The immediate effect is that the precedent returns to the previously held position of Dred Scott v. Sandford. 60 U.S. 393 (1857).
In writing the majority opinion Justice Scalia confirmed that the voters, the government and the States really didn't mean to pass and ratify the 14th Amendment, but there was no political capital to be gained by its repeal. He therefore concluded that the clear role of the Court was to act in loco parentis for the people and government.
He added that since there were no longer any slaves currently held in the United States, the protections afforded by the 14th Amendment were unnecessary, and simply a racial entitlement. He signaled that the Voting Rights Act would probably have to fall by the same measure, as black people are no longer citizens.
