White House spokesman Jay Carney
says that Dzhokhar Tsarnaev will not be treated as an enemy combatant because he is a U.S. citizen:
Boston bombing suspect Dzhokar Tsarnaev "will not be treated as an enemy combatant," White House press secretary Jay Carney said Monday. [...] Tsarnaev, Carney said, is a U.S. citizen and should be treated as such and tried in civilian court. "This is absolutely the right way to go and the appropriate way to go," he said.

reports Tsarnaev has already been charged, but that the charges are under seal:
U.S. officials brought charges against Boston Marathon bombing suspect Dzohkhar Tsarnaev while he lay in his hospital bed on Monday, a federal court official said. "There has been a sealed complaint filed," said Gary Wente, circuit executive for the U.S. Courts for the First Circuit, who said that a magistrate judge was present when Tsarnaev was charged at his bed in Beth Israel Deaconess Hospital.
The news that the Obama administration will respect the Constitution and follow the rule of law will surely drive Republicans like Lindsey Graham and Peter King crazy. Graham and King had aligned themselves with the Donald Trumps of the world, believing that the constitution should be suspended and that Tsarnaev should treated as an enemy combatant, because terror.

On April 21, 2013, the FBI searched DZHOKHAR TSARNAEV's dormitory room at 7341 Pine Dale Hall at the University of Massachusetts at Dartmouth, pursuant to a search warrant. The FBI seized from his room, among other things, a large pyrotechnic, a black jacket and a white hat of the same general appearance as those worn by Bomber Two at the Boston Marathon on April 15,2013, and BBs.
