This will be appealed to the circuit court but the right is crowing at this as a win.
This leaves many in states using exchanges fully responsible for payments for their health insurance despite the obvious need for subsidies.
The D.C. Circuit Court of Appeals said the Affordable Care Act does not permit the IRS to distribute premium subsidies in the federal ObamaCare exchange, meaning those consumers must bear the full cost of their insurance.
The 2-1 decision by the three-judge panel in Halbig v. Burwell sets up a major legal showdown that conservatives believe could deal a fatal blow to President Obama’s healthcare law.
The government is expected to appeal the ruling to the full D.C. Circuit, but even if the administration triumphs there, the case appears destined for the Supreme Court.
Forbes covers the backstory on this case but I warn you the writing is seriously barf worthy.

According to Armando my sentence above does not convey this:
The decision prohibits subsidies and tax credits in states where there is no state exchange only.
I don't see a difference but if it clarifies-meh.
10:09 AM PT: Looks like the appeals court has made a ruling supporting subsidies.
