Funny how "Prosecutor" Bob McCullough never mentioned any of these witnesses (in his 1 hour filibuster the other night), but rather the County "Prosecutor" abruptly dismissed them, because they did not conveniently corroborate the Defense Case he had just weaved for his kindred-soul "in Blue."
Only Witness 10 was worth highlighting in McCullough's mind -- even though his story was as "faulty" as as any of the other Witnesses that McCullough was ALL too quick to dismiss -- in one fell swoop blanket statement.
Witness 10 instead got 'gently coached' by a "Detective with the St. Louis County Police Department's Bureau of Crimes Against Persons" -- Witness 10 DID NOT have to endure the Cross-Examination from FBI "Special Agents," as so many of the "other" Witnesses had to endure.
Here's are some highlights from some of the dozens of other non-corroborating Witnesses "for the Defense" (as if this were "the real trial" or something) ...
Witness-16
[pg 12]
Witness-16: So I initially thought that he was in trouble and he was the one hidin'. So, at that point, I turn, go to the next window. 'Cause you can't really see after, from that window anymore. And, go to the next window. And at this time, I heard another shot fired while they were running. After that, he then turn, had his hands in the air, by the time that I saw him have his hands in the air, he got shot I heard two shots like specifically in my head I saw those two shots. And he dropped down like kinda drop hands first, then knee, then face and everything else. So that's why I did not see him move towards the police at any time.
Special Agent: Ok. And then what did you do?
Witness-16: Ok, then after that. l just I immediately ran and got my phone. It was on the charger for like, it was horrible, it was cracked everywhere, so it was on the charger, so surprisingly I even got to the camera, and by the time I walked, actually outside of my door was two police officers on the scene.
Special Agent: Ok.
Witness-44
[pg 12]
Special Agent: And he was, he had, he, Michael Brown had gone, um further away from where you were at this point?
Witness-44: Yes.
Special Agent: Ok. So at that point..um..how clear were things? Cuz I know you said
you
Witness-44: Yeah, vision problems.
Special Agent: ..your vision problems, right?
Witness-44: Yeah.
Special Agent: So you were able to see that there was a figure there, correct?
Witness-44: Yes. (laughs)
Special Agent: (laughs) And he..
Witness-44: It's not that, (laughs) that bad.
Special Agent: I know you, I know. But you able ta ... I mean you knew there was a person there.
Witness-44: Yeah.
Special Agent: Right? Ok. Um, and, and then he, and then he um..
Witness-44: He paused after he um..how do say..it wasn't really a run, cuz he didn't get far. Well after he stopped, he turned around, and he put his hands about shoulder length. It wasn't in the air like everybody doin'. He was about like this.
Special Agent: Ok.
Witness-44: It's like..
Special Agent: And so I just wanna...for the tape now..you're..you..you have your arms kinda close to your body, is that right?
Witness-44: Yeah. They were about shoulder length, you know when somebody's scared, like they're backin' away from something like "Whoa." No hands spread kinda backwards.
Witness-37
[pg 6]
Witness-37: And by time he gets out his vehicle, look, after the first shot that's when guy that was with, with Mr. Brown ducks. Mr. Brown take off that's when the guy that was with Mr. Brown ducks behind the police car in between police car and the car that was right behind the the police car. He duck in between those. And by the time Mr. Brown got that ten, fifteen feet the officer shot more shots from inside his vehicle, and before I knew it, the officer got out, kinda gave him a chase and that's where I see Mr. Brown slow up and throw his hands up. And the officer, like, patiently walked towards Mr. Brown, and that's when I seen another sh-like two, three shots fired at point blank range. That's when I see Mr. Brown, is it alright if I stand up?
Special Agent: Um hum. Um hum. Sure.
Special Agent: Okay, this officer and Mr. Brown he
Special Agent: So is, just real quick, is the officer facing, are we f-- are they facing each other?
Witness-37: Just like this.
Special Agent: Okay.
Witness-37: And that's when I seen 'em shoots his firearm again. Uh, I say probably about another two, three shots. And that's when I seen Mr. Brown lean over, hit his head, right on the concrete. Uh.
Special Agent: And how far away are they when that happens?
Witness-37: They ...
Special Agent: Closer than you and are now?
Witness-37: This is -- this is ... Just like this.
Special Agent: Just right there?
Witness-37: Just like this, he, once he got out his vehicle, he patiently, he gave, like I say, he gave a little pursuit I guess, if the shots from the vehicle that was firing after Mr. Brown got away, I don't know if they hit him in his back or what, but it slowed him up whatever it was. And that's when he stopped threw his hands in the air. He just like this, the officer gave a pursuit, he slowly walked up hit him two, three more times. Pow, pow, pow. He leaned over, hit his head. He laid flat just like this on the concrete. And that's when I seen the officer, patiently took his time, stood over, fired more shots.
Special Agent: How many?
Witness-37: I counted, I counted ten.
Special Agent: Ten?
Witness-37: I'm not just -- ...
Special Agent: Ten total?
Witness-37: Total.
Special Agent: Okay.
This next witness' testimony was more about
Michael's character than about the height of his surrendering hand gestures ...
A 'bit of humanity' that the FBI Special Agent would call "veering off" topic ...
A 'bit of humanity' that McCullough would later dismiss as 'only so much street gossip' ... not at all in-line with "the demon-hulk" picture, that 'he allowed' to be painted, in his unusual courtroom proceedings ...
Witness-14
[pg 7]
Special Agent: Okay.
Witness-14: As Michael was running away the other gentleman Mike went one way the other gentleman went the opposite direction.
Special Agent: The other gentleman meaning Michael Browns friend?
Witness-14: Michael Brown's Friend.
Special Agent: Do you not know his name?
Witness-14: No, don't -- I don't know him. Uh, I've seen Michael Brown in the neighborhood he passed me because myself and the other lady we always sit out. Ah, I'm collecting social securities and she is retired. We just sit out and your know we talk he just walks around and I've seen him walk passed 'cause he has a friend who stays in apartment who's just beyond me and he would always come by and say hey ya know, how you doing sir how you doing ma'ma you know how you all doing you know everything else. That's the only contact I has with him other times I may have seen him at the stores in the neighborhood.
Special Agent: Okay and we a veering off a little but just -- just so I don't forget to ask you said he has a friend that leaves near you Michael Brown has a friend that lives in the apartment complex.
Witness-14: I have no idea about that gentleman.
Special Agent: Oh, I thought you
Witness-14: Oh Michael Brown that has a friend that stays out there not the one that was with him I know nothing about.
Special Agent: I understand that let me just ask you the friend that Michael Brown sees stays with or knows in the apartment complex do you know that friends name?
These "uncoached" Witnesses who bravely stepped forward --
told what they saw -- to give Michael Brown his day in court ...
These Witnesses and many more like them do not have to be dismissed by the Public, as quickly as there were in McCullough's 'pre-emptive Defense Trial'.
Let their plain words (pdfs) and their humble bravery stand, as a testament against those who would use their words and actions against them -- all for the sake of short-circuiting the idea "Equal Justice under the Law." ... For ALL.
These unbalanced scales, must one day find their True North, in all corners of the Land.
