This was
completely predictable.
Just minutes after a judge ordered Kim Davis released from jail on Tuesday, her lawyers told CNN that she would violate a court order by forcing her clerks to stop issuing marriage licenses to same-sex couples. […]
CNN correspondent Martin Savidge, who was at the jail, explained following the order that her attorney, Harry Mihet, said that the judge had ordered the release because her office had satisfied the court by issuing marriage licenses to same-sex couples while she was behind bars.
“The problem here is that the attorney says she has not changed her mind, that Kim Davis is adamant that as long as her name appears on those marriage licenses, she objects and she will attempt to stop those licenses from being distributed," Savidge reported. “Which means if she goes back on the job as is expected, she will bring the process to a halt. That’s what her attorneys believe."
Davis would happily be sent back behind bars. She can be a martyr there. She can make
revolting comparisons of herself and Rosa Parks and
MLK. (BTW, their descendants should sue her for defamation of character on their behalf.) The judge shouldn't do it. He shouldn't give her more opportunity to self-aggrandize, more opportunity to create drama.
There are other options available that will guarantee marriage licenses to all eligible couples, and no profit to Davis. As a federal judge, Bunning can order that she can be barred from issuing all marriage licenses, and even take away the part of her salary that's attributable to that part of her job and redirect it to the office of Rowan County Judge/Executive Walter "Doc" Blevins who has the power and has expressed a willingness to do the job. She can also be personally sued for damages by the couples she's refusing. Sure, wingnut welfare will be happy to jump in and prop her up financially, but at least she wouldn't be obstructing justice.
