Kim Davis' supporters, in the wake of her release from custody, are now trying to push the issue even further. They are demanding that deputy clerks who issued same-sex marriage licenses, be fired immediately for "breaking the law." [Of course, Davis is the one who actually failed to comply with a court order and broke the law herself. The deputies are only following Bunning's orders.] It's not clear whether they mean God's law or the Kentucky statute that prohibits same-sex marriage, that was nullified by the Obergefell ruling by SCOTUS.
5 out of 6 clerks have issued at least one same-sex marriage license since Davis was sent to jail for contempt. The only clerk who hasn't issued a license is apparently, Davis' son, Nathan. From what I can gather, Davis has the power to hire and fire her deputies (she hired her son soon after she moved into the County Clerk position in January.)
Davis may just try to fire her assistants. Liberty Counsel has said that her determination to not issue same-sex licenses has not been broken. It's expected that she will rejoin the battle when she decides to return to work which could be anywhere from tomorrow to Monday.
If she does fire them, they probably have legal recourse to file a suit against her and the county. Additionally, because of Judge Bunning's order, that would mean another contempt hearing for Davis. This time it could result in jail time and fines.
The Davis situation is getting out of control. She, and her followers, have set themselves up as scofflaws and virtual vigilantes. There may be a number of methods of settling this from court hearings to sanctions issued by the county. Davis' poor atttempt at cheap theater needs to be ended.
