As a retired lawyer who filed many successful lawsuits challenging various aspects of “the system,” I am moved to ask a question. Can anyone invent a lawsuit in which we seek to enjoin the Electoral College (EC) from certifying Trump as the President, on the grounds that he lost the popular vote? Obviously the EC is embedded in the Constitution, but isn’t there also a provision somewhere that says that the majority rules? It seems to me that such a lawsuit, if we could frame a colorable argument, would obtain enormous public support; in addition, if we filed in the correct circuit, we might get a favorable appellate decision, and then the 4-4 supremes would not be able to overrule it, and we’d win.
There’s probably nothing here, but maybe someone is a better constitutional lawyer than I and can come up with a constructive idea. i guess under the present circumstances everyone is clutching at straws. This is my straw.
