I worked for several years at a detox here in Colorado, got to know the police who visited with clients, and of course discussed issues from time to time. DUI stories and opinions were common, of course, but several times the subject of guns and alcohol came up.
I was assured several times that (1) possessing a loaded weapon while under the influence or in possession of an open container was essentially the same offense as drinking under those circumstances. And (2) well, yeh, no real attempts were made to enforce that law, except when forced to by some misdeed.
I’m no legal researcher, and I am looking for the statute which addresses guns and intoxicants. Laws keeping arms and liquor apart must apply in other, if not all, states. I doubt they are enforced anywhere, esp. states where more and more ‘cowboys’ are packing heat because, well gosh, it’s their right to do so. Do they leave their guns at home when out on the town, when they are involved with or around alcohol consumption?
Anyway, a number of laws around guns are ignored, but this particular facet of the issue should be part of the discussion. I am asking for input about other states...just in case anyone else reads this…..thanks.
