We must demand that our Democratic congressmen and women refuse to consider any Supreme Court nominated by a Republican President until after the 2017 Senate elections, at least. Maybe the Senate class after that even. Anything but be the responsible adults in the room. An eight member court has already had positive benefits in Dow paying off claims instead of taking a chance in a court not being automatically pro-business. This will lead to radically different laws in some different parts of the country but the USA is pretty un workable as a single nation anyway. Some places, like those covered by the Ninth Appeals circuit, will not have to deal with being held hostage by neo Confederates from the over powerful South. Those, like myself, who live in the Fifth circuit will fare less well. I find it interesting that the Republicans, who see any attempt to alleviate the structural inequities of our nation as being ‘quotas’, basically demanding a ‘conservative seat’ quota for Scalia's seat. Supreme Court nominees are the reason all Sander’s supporter’s must work for Clinton’s election. In foreign policy there seem few real differences between Republicans and Democrats. Our present political stasis prevents much congressional action. The Supreme Court is one of the only places where change or continuity can be achieved in this day. This is why a court without a conservative majority is so terrifying to Republicans. This is why we must not let their Cold Civil war work. I have been calling the Senate offices of Sen Reid and Leahy to suggest this course of action ( basically acting Republicans ). I would hope we can pressure our representatives to meet Republican obstruction with obstruction.
