Gregory L. Diskant makes the legal argument that in failing to act on Obama's Supreme Court nomination the Senate is waiving its right to advise and consent. He argues that Obama should notify the Senate that they have 90 days to act on the nomination or he will consider them to have waived their right to advise and consent, and will appoint Merrick to the Supreme Court. If you concur, please sign the whitehouse.gov petition to appoint Merrick Garland to the Supreme Court, and then share the link on your social media accounts and blogs!
As much as my raging liberal heart would love to see Obama use Diskant's argument to thwart Republican obstruction, I must acknowledge constitutional law professor Ilya Somin lays out a legal argument that is more convincing to the honest intellect.
