The 9th district court of appeals just upheld a ban prohibiting medical marijuana card holders from purchasing firearms. The case was originally brought by a lady in Nevada who was refused by a gun shop there the store owner cited that marijuana, regardless of medical, or otherwise, is still illegal on the federal level. Because of this, they are considered “prohibited” and thus illegal to enter into that transaction . FYI, this would also cover states where pot has been legalized.
i hadn't realized there had been an appeal pending. I do recall this exact situation in Michigan (I think) a few years ago where someone used his MM card for ID. I know folks initial reaction is going to try to introduce alcohol, somehow into this equation, but it's about what is legal on the federal level. Those laws have to change first.
