“Oh my God” was what both Joe Scarborough and Mika Brzezinsk uttered when confronted with the melange of mendacity and mangled mutterings from White House Advisor Steve Miller, the purported co-author along with Stephan Bannon of Trump’s completely failed Muslim ban executive order.
Apparently somebody never heard of Marbury v Madison.

The “Morning Joe” host has been an outspoken critic of Miller, whom he has describedas too inexperienced and immature for his position, and Scarborough and his fellow panelists were left speechless by the official’s shouted claim that the president was “correct 100 percent of the time.”
“Oh my God,” said co-host Mika Brzezinski, who later suggested Miller should be fired in a tweet posted during the broadcast.
“Oh my God,” Scarborough agreed. “It’s so much worse than I ever thought. Wow.”
“(They are) questioned, my young, little Miller,” Scarborough said. “They will be questioned by the court — it’s called judicial review. Alexander Hamilton and James Madison wrote about it in the Federalist Papers, it was enshrined in Madison’s Constitution.”
Go back and read the constitution,” he said. “The White House has got to stop embarrassing themselves by putting this guy out there.”
Scarborough said his performance was worse than then-United Nations ambassador Susan Rice after the 2012 Benghazi attacks.
“That was horrendous and an embarrassment,” he said.
He warned that Trump, if he followed Miller’s advice and disobeyed court rulings he didn’t like, would be removed from office.
“We would have impeachment proceedings within the next six months, Donald Trump would be impeached,” Scarborough said.
Scarborough said the “I” word. I mean, only a few days after my own representative Maxine Waters said it. These people are in a tailspin.
And just to contrast and compare for the sake of posterity: Yes, this was worse than Susan Rice after Benghazi, because she actually said exactly what the national security and intelligence community had told her to say. She never actually said it “wasn’t a terrorist” attack, she said that they thought other protest in various cities around the world that same day may have inspired this attack.
Rice: let me tell you the best information we have at present. first of all, there's an fbi investigation that's ongoing and we look to that investigation to give us the definitive word as to what transpired. but putting together the best information that we have available to us today, our current assessment is that what happened in benghazi was, in fact, initially a spontaneous reaction to what had just transpired hours before in cairo, almost a copycat of the demonstrations against our facility in cairo, which were prompted, of course, by the video. what we think then transpired in benghazi is that opportunistic extremist elements came to the consulate as this was unfolding. they came with heavy weapons, which unfortunately, are readily available in post revolutionary libya. and it escalated into a much more violent episode. obviously, that's our best judgment now.
That’s what drove congress bonkers for the next 3 years. She didn’t say Benghazi was because of the VIdeo, she said Cairo was — and Benghazi was an offshoot of Cairo. That's been shown by history to be essentially correct with the one caveat being that although “Innocence of Muslims” was the spark that lit the flame in Cairo, things were different in Libya because of so many in the public and “extremist elements” — including members of ansar Al-Sharia — were in the vicinity and armed with heavy arms following the civil war, so it went into an immediate attack and skipped right past the "demonstration/protest” phase like what occurred that same day at other embassies around the world.
The GOP theory then was that the White House directed Rice to lie and go against what the intelligence information was at the time for political reasons, because the Obama administration didn’t want to admit that elements of al Qaeda could have done this, never mind the fact she was saying “extremist elements” from day one. They didn’t yet know who it was exactly, but they knew they weren’t friendlies. ansar Al-Sharia briefly took credit for the attack — which is what Hillary Clinton told her daughter — but they rescinded that claim the next day saying they didn’t “lead” the attack.
Be that as it may, what was a theory then is fact now. We now have an Administration that can’t admit when they don’t have a crowd that’s the “biggest ever” for their Inauguration, that they didn’t win the popular vote without there being “millions of illegal voters”, or that the judiciary have a role to play in response to Presidential executive orders. To bolster these false claims they have to send out this unstable little autocrat who continues to peddle their delusional conspiracy theories which are all far, far more loopy than anything alleged after Benghazi and his performance yesterday was just astoundingly pathetic and petulant.
Yet Miller isn’t the only neo-jackboot in the parade as we were shown on The View today.
Jedediah Bila, a conservative, remarked that perhaps the 9th U.S. Circuit Court of Appeals had blocked the controversial executive order because the court lacked important national security information that Trump had seen. She also decried the decision as “judicial activism.”
But her comments were quickly rebutted by co-hosts Sunny Hostin and Whoopi Goldberg.
“That’s a misnomer,” Hostin, a lawyer, said. “This whole notion of judicial activism. Guess what? A judge’s law is to be active in interpreting the law. That’s what judges do.”
National Security information the court didn’t have? They asked for that information and the government didn’t even try to answer them. It’s not that they said they had classified intel that couldn't be shared, they refused to answer the question. When that happens the benefit of the doubt goes to the opposing side.
Plus this executive order was written up and signed just days into his Presidency when he hadn’t been taking all of his daily briefings claiming “I’m, like a smart guy and I don’t need to hear the same thing over and over again” and on top of all that they claimed, in court, that the rationale for listing these seven countries was based on a determination that can come from the Obama Administration, but there was no “Bowling Green Massacre” , they never banned anyone and — as Whoopi points out — they already fixed the vetting process.
This is bullshit.
