PENFIELD PA - The owner of a Clearfield County cemetery was ordered by a judge to remove no trespassing signs around a cemetery on his property.
Attorney Leanne Nedza said owner Bruce Gerber, of St. Marys, was served the paperwork Wednesday.
According a complaint filed on behalf of the Huston Township Cemetery Association by Nedza, Gerber was “ordered to remove any obstructions which impede persons from entering the Mt. Pleasant Cemetery for any lawful purpose.”
As of 5 p.m. Thursday, he still hadn’t removed the signs and fence.
It was the beginning of May when people with loved ones buried there said the cemetery became off limits.
According the complaint, a member of the cemetery association was advised by Gerber that he blocked the entrance to the cemetery because he was concerned about getting sued.
The complaint also states, “As Memorial Day is approaching and is certainly an important day for families to go to said cemetery, the association is requesting that the court enter an order which required Gerber to remove the barrier which impeded entrance to the cemetery and to remove the no trespassing sings."
The complaint said Gerber’s actions were made without regard to the association’s rights and privileges, as its in charge of maintaining the cemetery.
A hearing is scheduled for 8:30 a.m. Friday at the Clearfield County Courthouse to discuss the court order.
