Multiple ethics complaints have been filed against federal judge and—as of this moment—unconfirmed Supreme Court nominee Brett Kavanaugh. Those complaints have been filed in the court where he currently works, the U.S. Court of Appeals for the D.C. Circuit. In a profound display of “there are still people with ethical concerns in this world,” the chief judge of that court has recused himself from hearing these complaints. Because the chief judge of the court where Kavanaugh does his thing, for at least a few more hours, is Merrick Garland.
As Buzzfeed reports, Garland did not give a cause for stepping back from looking at complaints against his junior colleague. For now, those complaints are being handled by another judge senior to Kavanaugh on the D.C. Circuit.
In many cases, the Supreme Court transfers complaints about an Appeals Court judge to a different court. They have not done so with complaints against Kavanaugh. Because if the vote goes as Republicans certainly expect this afternoon, Kavanaugh can kiss all concerns about ethics charges good-bye.
Lower court judges are subject to a code of conduct and an internal misconduct review system, but Supreme Court justices are not.
Even the charges that were made against Kavanaugh before he gets represented by Gritty will be wadded up and thrown away if Kavanaugh wins. Just like the concerns of American women, as well as all thought of a fair or impartial court.
