Plain and simple, one or more senior Democrats need to make a statement that the Kavanaugh appointment and confirmation will not be deemed legitimate — and will be subject to revocation by impeachment if the process continues to be irregular and that Democrats demand 1) the full record which was requested and 2) a full independent investigation of the allegations of sexual misconduct and assault which have come forth over the past week. Absent that, Republicans should anticipate that a Democratic house will actively investigate these matters in 2019 as predicate to impeachment and removal by a Democratic Senate in either 2019 or 2021. This statement will be useful for what it proports to be — a statement of purpose and intention which will be a self validating “mandate” at a later time. It may also serve as a cause for Republicans (who are very familiar with and will recognize such tactics) to re-evaulate whether ramming Kav onto the S.Ct. subject to potential removal is better than the probability that they are able to confirm a slightly more moderate justice who will likely give them a majority for a generation.
