Dear Mark,
I know you never expected that your youthful shenanigans would catch up with you, but now they have. The actions you take over the next few days will be very consequential to you.
I know you want to support your old buddy Brett, but you are about to be interviewed by the FBI. Lying to the FBI (Making false statements -18 U.S.C. § 1001) is a serious crime. It is a felony punishable by up to five years in prison.
So far, you have been pretty careful. Your lawyer did a good job inventing the mysterious pledge "under penalty of felony." Plus, all you've basically said so far is you don't remember.
This is all about to change. These guys are going to ask a lot of detailed questions, and not just about the night in question. For example, what's a Devil's Triangle?
You need to decide whether you want to start telling lies, and I'm warning you that would be a big mistake. The truth will come out. Those that tell the truth will minimize their personal consequences. Those that lie will go to prison.
You don't want to go to prison Mark. Tell the FBI the truth. The whole truth to the best of your recollection.
Don't just take my word for it. Get a good lawyer. Not the one provided to you by Brett's friends. Ask him or her what you should do. Get your attorney to make the best deal for you they can.
You've got one chance at this Mark. Don't screw it up. Do yourself a big favor and tell the truth.
