The Justice Department now says the courts should strike down the entire Affordable Care Act — not just its protections for pre-existing conditions. The department signaled its new, broader position in a legal filing Monday, part of a lawsuit challenging the law's individual insurance mandate.
Why it matters: A ruling striking down the entire ACA would upend major parts of the health care system. Millions of people would lose their health care coverage, and a host of seemingly unrelated policies — including new experiments in how Medicare pays for care and an entire class of prescription drugs — would also go out the window.
All of us on DKos knew that the Republican promises to protect pre-existing conditions were bullshit lies. Now they want to junk the whole ACA and strip MILLIONS of people of their healthcare. Despicable, but a political gift to us.

The Trump administration on Monday said it supports a federal judge's ruling that the entire Affordable Care Act should be scrapped, signaling a shift in the Justice Department's position.
"The Department of Justice has determined that the district court's judgment should be affirmed," three Justice Department lawyers wrote to the 5th Circuit Court of Appeals, which is now considering the case. "[T]he United States is not urging that any portion of the district court's judgment be reversed."
