The Arizona Supreme Court has 7 Justices, 5 appointed by current Governor Ducey and 2 by former Governor Brewer, both of whom are Republicans. The Arizona Supreme Court was expanded (packed?) from 5 to 7 during Governor Ducey's term in 2016 and he appointed two more Republican judges.
Yesterday, December 8, 2020, a date that will live in rationality in Arizona election litigation, the Arizona Supreme Court unanimously confirmed the dismissal of the so-called election challenge filed by Republican Party Chair Kelli Ward, and specifically confirmed the election of the Biden Electors under Arizona law.
As a further knife into the completely baseless nature of the challenge, the Court unanimously stated:
"Because the challenge fails to present any evidence of “misconduct,” “illegal votes” or that the Biden Electors “did not in fact receive the highest number of votes for office,” let alone establish any degree of fraud...IT IS ORDERED affirming the trial court decision and confirming the election of the Biden Electors under A.R.S. § 16-676(B)."
Note the use of the "any" twice, which makes it abundantly clear that the Court believed that this challenge was complete BS. In litigation, this would be called a complete and total victory with a body slam against the Plaintiffs, excepting only that the Court did not award attorneys' fees against the Plaintiffs.
All election lawsuits in Arizona, whether filed in federal or state court, were decided against Trump and the Republicans.
Interestingly, the suit filed by the Texas Attorney General in the US Supreme Court seeking to overturn the certifications in so-called swing states did not name Arizona. Apparently not even the indicted Attorney General of Texas (indicated for securities fraud in Texas in 2015 and yet to stand trial for some inexplicable reason) could bring himself to sue Arizona.
