Republicans have the votes for Ginsberg's replacement! Per the NY Times, the only question is whether the vote is before or after the election. While Democrats can’t stop this power grab, they can take away the only thing that is more important to this court than power — its legitimacy.
McConnell refused to allow a hearing on Obama’s judge in the final year of his term, so Democrats should refuse a hearing on Trump’s judge in the final year of his term — Just don't attend any of the hearings. Yes, she will get confirmed — but that is happening anyway. Rather than whine to the camera’s how unfair it is, demonstrate to the country what a farce it is. This way, the story will be the half empty Senate chamber and how the court is now as partisan and polarized as the rest of the country.
This is not sour grapes or scorched earth, but a necessary step toward reform. Once at least half the country sees this court as illegitimate, the easier it will be to reform it.
And believe me, the hits will start coming very soon. The ACA will be struck down next year without Ginsberg. Marriage equality and a woman's right to choose will all be on the chopping block soon after. The public needs to know who to blame.
