A Rochester man identified as a member of the Proud Boys who allegedly smashed a window at the Capitol on Jan. 6 to allow rioters inside is considering a guilty plea, according to a recent court filing.
A recent filing by Dominic Pezzola’s attorney said Pezzola accepts responsibility for his actions and wants to make amends. It was not clear if a plea deal has been offered.

In the court filing, Pezzola's attorney wrote that Pezzola, a Marine reservist for six years who was honorably discharged, was a participant at the Capitol breach but "there is no evidence nor claim that he ever physically harmed any person there,” the Rochester Democrat and Chronicle reported.
He’s likely looking to make a deal now that he’s seen what the Feds have on him...

One of the Rochester men charged in the connection with the Capitol riots was back in court Wednesday for a hearing over access to evidence.
Dominic Pezzola, a member of the Proud Boys, is being held on federal charges, including conspiracy and assaulting an officer.
Prosecutors have 45 days to hand over evidence in the case, giving Pezzola's attorneys time to review it before a trial date can be set.
What do they have? Oh, just a thumb drive full of bomb making instructions...

A Proud Boy member accused of shepherding hordes of angry MAGA fans into the Capitol and saying he’d kill Vice President Mike Pence “if given the chance,” had a USB filled with instructions on making homemade firearms, poisons, and explosives, prosecutors alleged in a Friday detention memo. Dominic ‘Spazzo’ Pezzola is facing several charges after he broke into the Capitol with a police shield. He was seen in photos wearing a Proud Boys t-shirt, a U.S. Marine Corps-logo button and an “0351” tattoo on his right arm signifying the Infantry Assault Marine military occupational specialty.
In the memo, prosecutors allege Pezzola was part of the mob that confronted Capitol Police officer Eugene Goodman outside the Senate Chamber. “Where they meeting at?” Pezzola said, according to the memo, referring to the members of Congress voting to certify Biden’s win. “Where they counting the votes?”
After his arrest, prosecutors said FBI agents found the thumb drive at Pezzola’s home. “A sample of titles includes, but is not limited to: multiple serials of a series entitled ‘Advanced Improvised Explosives,’ those serials including ‘Explosive Dusts’ and ‘Incendiaries’; ‘The Box Tube MAC-11,’ with subtitle, ‘The Ultimate DIY Machine Pistol;’ ‘Ragnar’s Big Book of Homemade Weapons;’ ‘The Advanced Anarchist’s Arsenal: Recipes For Improvised Incendiaries And Explosives.’” Prosecutors said hundreds of similarly titled PDF files were on the thumb drive. “Pezzola poses both a serious danger to the community and a serious risk of flight,” prosecutors argued.

After two different federal judges denied him bond earlier this year, Pezzola brought on a new legal team, attorneys Marty Tankleff and Steven Metcalf, to mount a third attempt at getting him out of jail while he awaits trial on 10 charges in connection with the January 6 Capitol riot. The government has alleged Pezzola, a member of the New York branch of the Proud Boys, conspired with other members of the far-right group to obstruct the certification of Electoral College votes. If convicted, he could face up to 20 years in prison on the obstruction charge alone.
In their most recent motion, filed late last month, Tankleff and Metcalf argued Pezzola’s constitutional rights are being violated by the restrictions the D.C. Jail places on his access to the voluminous evidence in the case. The Department of Justice says it has already identified more than 2,300 hundred hours of body-camera footage alone, and another 7,000 hours of video from the U.S. Capitol Police.
Kelly, who denied Pezzola’s second attempt at bond in March, said he took the lawyers’ complaints about evidentiary access at the D.C. Jail seriously – although he also pointed out that, by their own admission, Pezzola had not attempted to use the system in place. However, Kelly said he wasn’t sure they had raised any issues that would allow him to reconsider detention under the terms of the Bail Reform Act.

"How many of them were just trying to figure out what even happened on that day because it got completely out of control?" said Steven Metcalf, one of Pezzola's lawyers. "... They're making these guys out to be far more intelligent and far more technologically savvy than they were."
Federal prosecutors instead see Pezzola as a man who, stoked by false claims of a stolen election, was ready and willing to engage in violence. A judge has refused to release Pezzola on bail, pending trial.
Pezzola rushed the Capitol "after the first breach of the first barricades, which involved running over U.S. Capitol police officers, and he didn't back down, didn't say, 'Well, this isn't what I was here for; I wasn't here for assaulting law enforcement,'" Assistant U.S. Attorney Erik Kenerson said during a bail hearing for Pezzola. "He took advantage of that assault to move forward."
