Sidney Powell and the Kraken lawyers lost their appeal regarding the non-monetary portion of their sanction — i.e. they have to complete 10 hours (or whatever it is) of continuing legal education. However:
In a brief order, a three-judge appellate panel blasted the attorneys for failing to seek relief directly from U.S. District Judge Linda Parker, who imposed the penalties in August, and for dragging their feet before filing their 6th Circuit motion.
The attorneys involved in the litigation were also ordered to pay $175,000 in legal fees, though Parker agreed to pause enforcement of the payments while appeals play out.
Well, a least they got another stern talking to by the panel! Meanwhile, Powell is fighting her possible disbarment. Says “‘Perhaps’ the Kraken wasn’t real after all.” If only there were criminal penalties for defamation that didn’t require third parties to file civil suits to get these people under oath. She and Giuliani would have kept their mouths shut with their lies. As soon as they get under oath, they own up to their lies: “In the deposition, Giuliani said some of his evidence was based on Coomer's social media posts.” Voting needs to be sacrosanct and if you spread lies that an election was rigged or corrupt, you should have the opportunity to defend your claim in court.
Sidney Powell raised more than $14mm for her “stop the steal” fight, so if she is ever compelled to pay the fine for legal fees, she will probably be able to dig up the money somehow.
