Tim Levon Boughner interrupted the judge at his detention hearing last month and announced he was “done with this.”
A Michigan man accused of spraying police with chemical irritants and using a metal bike rack to push back against officers during the January 6, 2021, Capitol riot stormed out of his virtual detention hearing on Wednesday after being denied pretrial release, according to Law and Crime.
Tim Boughner, 41, has been in federal custody since December and at a detention hearing on Wednesday, Judge Zia M. Faruqui said that he did not plan to grant Boughner's request for pretrial release.

"This is in fact one of the few cases where I believe the risk of flight is a real concern," the judge said, adding that he was worried Boughner might desert to Canada if released.
When Faruqui further explained his reasoning for denying pretrial release, Boughner verbally fought back, saying "You really don't know what happened. You guys gonna believe what you guys wanna believe. So hey, it is what it is."
He then stood up and left the proceeding after the judge declined to release him…

Faruqui repeated what he had said at the beginning of the hearing: that Boughner could appeal his decision.
Boughner again interrupted the judge, cutting him off.
“You know what, I don’t care anymore, I’m done with this,” he said. “So I’d like to go eat my food and play cards.”
At that point, Boughner’s attorney James McHugh, a federal public defender, asked for some time with his client in a virtual breakout room. After a few moments, McHugh returned to the hearing. Boughner did not.

Boughner was one of the more sought-after suspects in the siege with the FBI circulating photos of Boughner and a distinctive star-shaped tattoo near his right wrist. Online cyber sleuths who have helped investigators identify people during the siege referred to Boughner by the hashtag “#blackpufferwhitescarf.”
Boughner is being held without bond on several charges, including engaging in physical violence in a restricted building or grounds, civil disorder, and assaulting, resisting, or impeding certain officers with a dangerous weapon.
Prosecutors cite video footage showing Boughner among a crowd of rioters at the Capitol on Jan. 6 and say he used a chemical spray on officers. Later that day, he discussed the attack on social media, saying he "started spraying" and "f----- those cops up," prosecutors alleged.

The criminal case, filed in federal court in Washington D.C., describes how federal agents obtained a search warrant for Boughner's Facebook account. Agents reviewed multiple comments from the account supporting Trump after the 2020 presidential election and insisting he would be president for four more years.
Boughner is a career criminal first arrested for B&E in 1998...

Tim Levon Boughner appeared for a virtual detention hearing before U.S. Magistrate Judge Zia M. Faruqui Wednesday afternoon (1/12/22). Boughner was arrested in early December while sleeping in his vehicle at a rest stop in Lapeer, Michigan. In an interview with police, he allegedly confessed to assaulting officers at the U.S. Capitol Building on January 6, 2021, and also that he had recently deleted his Facebook page and had started driving north because “he had a feeling they were coming for him.”
In charging documents, prosecutors said bodyworn camera video and other footage from the Capitol riot shows Boughner assaulting police with a can of pepper spray. In posts on Facebook both before and after the riot, prosecutors say, Boughner reveled in the prospect of violence and then gloated about his participation in the riot.
Prosecutors said Boughner also has an “extensive and varied criminal history,” according to prosecutors. In a motion for pretrial detention, the DOJ said his first conviction was for felony conspiracy breaking and entering in 1998. He received a probationary sentence, but eventually served 1 year in jail after violating the terms of his release. Prosecutors said he had additional convictions in 2001, 2007, 2007 and 2008 – the most recent for domestic violence.
