According to Judge Amit Mehta, James is now expected to fully cooperate with the Department of Justice during the ongoing investigation into the Oath Keepers' role in the January 6 riot. Furthermore, he is expected to now provide grand jury testimony for affiliated trials.
He may spend up to 40 years in prison with a $500,000 fine for both seditious conspiracy and obstruction of an official proceeding.
James is accused of being the leader of a group of Oath Keepers called Stack Two, along with co-defendants Roberto Minuta and Brian Ulrich. They were said to have marched from the west side of the U.S. Capitol to its east side and breached the building's rotunda along with other Oath Keeper associates. According to the case's filing documents, James and Minuta began pushing back against Capitol officers and called the Capitol theirs.

Joshua James was originally arrested last March and the indictments have been piling up since then… Now it seems he’s cutting a deal and hopefully cooperating with investigators!

Joshua James, one of the 11 Oath Keepers charged with seditious conspiracy alongside the group’s founder Stewart Rhodes, appears poised to plead guilty Wednesday afternoon, a major development in the most serious criminal case to emerge from the Jan. 6, 2021 attack on the Capitol.
James was a member of the Oath Keeper’s leadership who repeatedly messaged with other Oath Keepers about planning for Jan. 6. Prosecutors say he breached the Capitol’s rotunda doors along with other Oath Keepers in the early part of the mob assault on the building.
The indictment against Rhodes and the others indicated that James described a massive arsenal of weaponry that the group had “on standby” in case violence escalated. Prosecutors have accused the Oath Keepers of stockpiling weapons at a Comfort Inn in Arlington, Va., though they never ultimately deployed it.

It’s unclear what the broader impact of James’ plea agreement will be, but other plea agreements from Jan. 6 defendants have typically included agreements to cooperate with federal prosecutors. Cooperation by James could provide prosecutors with valuable insight about the planning and mindset of those organizing the attack.

Greco faces a range of charges for associating with Stone from July 2019 through March 2021, in particular in Washington, D.C., during the Jan. 6, 2021, insurrection at the U.S. Capitol.
To make their case against Greco, NYPD prosecutors said they will submit a recorded statement from Joshua James, an Oath Keeper from Alabama facing federal charges of seditious conspiracy in connection with the D.C. riot.

In January, James and Minuta were among the 11 Oath Keepers indicted on charges of seditious conspiracy. James was charged with nine counts in that indictment, including allegations he instructed another person to destroy communications following the riot.
James will be the first member of the 11-person seditious conspiracy to enter a guilty plea in the case. Other Oath Keepers who have pleaded guilty to Capitol riot charges have been required as part of their deals to cooperate with the government’s investigation against the militia.

The day before the riots, James served as security for one of the speakers at a “Stop the Steal” rally in D.C., according to the affidavit. Photos showed James wore clothing with an Oath Keepers patch on Jan. 5 and Jan. 6.
James was pictured standing with other Oath Keepers, including Kelly Meggs, the self-proclaimed leader of the Florida Oath Keepers who was also charged with storming the Capitol, the FBI agent claimed.
Phone records showed James was in constant contact with one Oath Keeper on Jan. 5, exchanging six calls with the undisclosed member that day, according to the agent. James was also in contact with members on the morning of the riots, the agent alleged.
Back home he was considered something of a hero, that is until he conspired to overthrow the government he once defended...

In Arab, a town of 8,380 in northeastern Alabama, much of the community knew James, 34, as a soft-spoken, God-fearing family man with three young kids who ran his own pressure-washing business. Those who knew him better considered him a local hero—an Army combat veteran and Purple Heart recipient who got choked up when he talked to local teenagers about enlisting in the U.S. military.
But the federal agents who showed up on James’ doorstep on March 9 described a very different man: an extremist who had not just broken the law but also carried out an assault on the same government he had sworn to defend as a soldier.
For weeks, James had helped plan an operation to disrupt the certification on Jan. 6 of President Joe Biden’s electoral victory, investigators say, by coordinating and recruiting others to travel to Washington with paramilitary gear, including guns, tactical vests, helmets and radio equipment. A federal conspiracy indictment contends James and at least 15 other members of the Oath Keepers, an anti-government militia, had organized, equipped and trained ahead of the siege that left five dead and dozens more injured. James was among the throngs of supporters of defeated President Donald Trump who rammed their way into the seat of American democracy. “Get out of my Capitol,” James allegedly shouted at riot officers. “This is my f-cking building!”

5. On November 14 and 15, 2020, James met with Rhodes and others in the Washington, D.C., metropolitan area and at Caldwell’s Virginia farmhouse and learned about the start of their plans to oppose by force the lawful transfer of presidential power.
6. On November 16, 2020, James joined Rhodes and others on Signal, an end-to-end encrypted messaging application, in an invitation-only group chat titled, “Leadership intel sharing secured.”
7. In December 2020, James joined Rhodes and others in an invitation-only encrypted Signal group chat titled, “Dec 12 DC Security/Leadership.”
8. On December 11, 2020, Rhodes messaged the “Dec 12 DC Security/Leadership ”Signal group chat stating that if President-Elect Joseph R. Biden were to assume the presidency,“It will be a bloody and desperate fight. We are going to have a fight. That can’t be avoided.”
9. On December 14, 2020—the same day that presidential electors from each state and the District of Columbia cast their votes in the Presidential Election—Rhodes published a letter on the Oath Keepers website advocating for the use of force to stop the lawful transfer of presidential power. He sent similar messages that day to the “Leadership intel sharing secured” Signal group chat, in which James was a participant.
10. On December 21, 2020, James messaged the “Leadership intel sharing secured”Signal group chat, “SE Region is creating a NATIONAL CALL TO ACTION FOR DC JAN 6TH.... 4 states are mobilizing[.]” When he did not receive an immediate response, James posted,“DID NO ONE HEAR ME!!!! 3 STATES ARE MOBILIZING TO DC!!! Everyone in this channel should understand the magnitude i just sent!!”
11. On December 23, 2020, Rhodes published another open letter on the Oath Keepers website. Referencing the Certification of the Electoral College Vote scheduled to occur on January 6, 2021, Rhodes explained that “tens of thousands of patriot Americans, both veterans and non veterans, will already be in Washington D.C., and many of us will have our mission-critical gear stowed nearby just outside D.C.” Rhodes warned that he and others may have to “take to arms in defense of our God given liberty.”

19. In advance of and on January 6, 2021, James and others agreed to take part in the plan developed by Rhodes to use any means necessary, up to and including the use of force, to stop the lawful transfer of presidential power.
20. In the weeks leading up to January 6, 2021, Rhodes instructed James and other co-conspirators to be prepared, if called upon, to report to the White House grounds to secure the perimeter and use lethal force if necessary against anyone who tried to remove President Trump from the White House, including the National Guard or other government actors who might be sent to remove President Trump as a result of the Presidential Election.

41. On January 6, 2021, at 7:30 p.m., Rhodes messaged the “DC OP: Jan 6 21” Signal chat, “Thousands of ticked off patriots spontaneously marched on the Capitol. . . . You ain’t seen nothing yet.”
42. Rhodes later added on the “DC OP: Jan 6 21” Signal chat: “Patriots entering their own Capitol to send a message to the traitors is NOTHING compared to what’s coming.”
43. At Rhodes’s instruction, James, Vallejo, and others met Rhodes that evening at a restaurant in Vienna, Virginia. Rhodes discussed saving “the Republic” by stopping the transfer of presidential power and began to make plans to oppose the Inauguration on January 20, 2021,including by having people open-carry firearms at state capitols around the country.

On January 8, 2021, James received a Signal message, in a group chat that included Rhodes, from an individual he understood to be an attorney for the Oath Keepers that stated,“STEWART: YOU ALL NEED TO DELETE ANY OF YOUR COMMENTS REGARDING WHO DID WHAT.
