An Idaho man who hit a police officer with a pipe as part of the mob that stormed the U.S. Capitol last year was sentenced Friday to more than four years in federal prison.
Duke Edward Wilson, a 68-year-old logger from the small city of Nampa, told U.S. District Judge Royce Lamberth that he didn't remember many of his actions. Prosecutors said he attacked at least three officers in a tunnel in the U.S. Capitol Building on Jan. 6, 2021.
Lamberth said the 51-month sentence — the maximum allowed under federal sentencing guidelines — was necessary because the insurrection was "a horrible day for our country."
"It's a message that the court has to send, that our country cannot deal with that," Lamberth said.

Assistant U.S. Attorney Christopher T. Tortorice showed Lamberth video of Wilson in the tunnel of the Lower West Terrace area of the Capitol, where one officer was crushed between doors at one point.
“Mr. Wilson is among the most aggressive people in that crowd,” Tortorice said.

Wilson told the judge, “I made a very bad decision by going in that place that day ... I’m very sorry I caused any injuries to any officers. I made a very bad decision. I deserve punishment for being in there. I didn’t have a plan. There was no plan to do all this. Some of the videos they showed me, I can’t believe I was doing that.”
The sentencing guidelines suggested a prison term of 41 to 51 months. Prosecutors advised Lamberth to impose 46 months. Wilson’s lawyer, Charles Peterson, asked Lamberth to go below the guideline range. Instead, Lamberth went to the top of the range, only the second time a judge has gone above the government’s recommendation out of the 10 felony sentencings so far.
Gonell said he was "face-to-face" with Wilson, who he described as leading the surge in the tunnel. The defendant shoved him and swung at him with a pipe, later picking up a flagpole and using it as a weapon, he recounted.
Gonell said he suffered cuts to his hands and his leg, a foot injury that required surgery, and a torn rotator cuff in his shoulder. He is still undergoing physical therapy and mental health counseling, he said, and remains on light duty with the Capitol Police - a designation that has significantly lowered his pay.
The officer said he does not believe that Wilson feels any remorse for the attack, and expressed outright disgust over sentences of only a few weeks in jail handed down to other Capitol rioters.
"Those who attacked the Capitol as insurrectionists should be punished. This was not a peaceful protest," Gonell told the judge. "I remember vividly that day what happened to me, to him, and his intent was clear to me - to go through the tunnel, to go through the entrance by all means."
