STEPHEN P. HALBROOK is a Senior Fellow at the Independent Institute and author of the Independent books The Right to Bear Arms, Gun Control in Nazi-Occupied France, Gun Control in the Third Reich, The Founders’ Second Amendment and That Every Man Be Armed.
has written Ukraine War Reintroduces U.S. Politicians to the Second Amendment without realizing its implications for the second amendment.
A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.
If the Ukraine war sets the bar for “the right of the people to keep and bear Arms” then that has to include the use of drones.
The Ukrainians have access to drone missiles called loitering munition which can be fired without targeting. They even have more experimental drones designed to control these drone missiles. So you set up a drone and give it access to drone missiles and walk way. The control drone will watch for the enemy and automatically fire the attack drones if spotted.
So there now are three possibilities for the future of the second amendment:
- No one, including even experts like Mr. Halbrook, has any idea the purpose of the second amendment anymore and the entire idea should be revisited.
- When some form of drone weapon becomes inexpensive enough any 18 year old American who passes a background check should be allowed to buy one.
- The second amendment implies limits to the kinds of weapons a military (including the US armed forces) is allowed to possess on American soil.
Of course there is already a ban on machine guns but gun enthusiasts will point out that fully automatic weapons don’t play a large role in modern warfare. Whether that’s the case or not it’s certainly not true for drones and the fully automated warfare that we can all see coming.
The Supreme Court is set to rule on carrying concealed weapons and finally nail down the laws of the 19th century wild west while simultaneously the Ukraine, engaged in 21st century warfare, proves that there is no longer constitutional support for any old fashioned weapon ownership.
