This isn’t much of a diary, more of a placeholder, but I didn’t see it mentioned elsewhere and thought it would be of general interest here that Trump’s 2016 campaign has apparently conceded that the NDA’s they forced their staff to sign are unenforceable:
Bloomberg has a article on it here:
www.bloomberg.com/…
The actual proposed settlement is here:
assets.bwbx.io/…
A takeaway bit is this:
“The Campaign, as of June of 2021, stated in writing that it would cease any enforcement of the Employment Agreement’s non-disclosure and non-disparagement provisions against Ms. Denson. While the parties were conducting class discovery, the Campaign made another sworn declaration that it “shall not ever” enforce the non-disclosure and non-disparagement provisions and stated that it notified the putative class members in a signed writing that they are “no longer bound” by these provisions.”
I have no detailed knowledge of the case, so will happily delete this diary if/when someone more informed puts up something more substantive.
