Defense attorney Roger Roots for Proud Boy Dominic Pezzola files a motion for a mistrial. He cites grievances with the admission of the "1776 Returns" doc and claims the government has framed Henry "Enrique" Tarrio or is attempting to "smear" him.

Root writes in his request for a mistrial that he would also accept the government striking the “1776 Returns” document from the court record altogether. He argues the government improperly suggested that Tarrio "authored, subscribed, ratified, or approved the plan" in the doc to storm federal buildings.
Pezzola's attorney cited this Politico article as the basis for his request; he notes testimony from Sam Armes to the J6C where Armes said 1776 Returns included ideas he had formulated for a 'war gaming' exercise but he didn't author the document.
Armes told the select committee that he shared some of those war game exercises with a "friend in the crypto industry" who later shared it with Tarrio. Yesterday, prosecutors pored over texts that showed a romantic interest of Tarrio's shared the document with him: Erika Flores.
To my eye and ear yesterday, I didn't come away with the impression that the government suggested 1776 Returns was authored by Tarrio, nor do I recall hearing that testimony from Agent Dubrowski. I recall testimony that he received it and I recall testimony about contents of the document.
It would appear by Roots' own motion that there is a fundamental misunderstanding of the facts about this record anyway.
