David Scanlan (R), the NH Secretary of State, is working with the State Attorney General to invoke the 14th Amendment, Section 3, to keep Trump off the ballot for the 2024 presidental election. Scanlan is not sure if it will succeed, hence the consultation with the State AG. Pakman goes on to say that removing Trump from the ballot pre-conviction may turn out to be a strategic mistake, because the MAGA crowd will say Trump is being scapegoated and the Democrats are trying to steal the election. However, he acknowledges they have been making stolen election accusations for some time. This writer thinks that should be of less concern than enforcing the 14th Amendment and making sure Trump can’t run.
Politico goes into more detail than Pakman, pointing out that NH Republicans are feuding about it, with some for and some against. Brian “Corky” Messner, a prominent attorney and former Trump-endorsed U.S. Senate nominee, believes Section 3 prohibits Trump from running again, as it pertains to insurrections. Others, such as Chris Ager, chair of the NH State Republican Party, is pushing back.
The move is considered a long shot, but it may set a precedent for other states who want to keep Trump off the ballot in 2024. It will be interesting and gratifying if this succeeds, and other states successfully follow suit.
