I find it amazing that Scalia thinks he can rule on the health care bill without reading it. I just saw this on Russia Today on the Big Picture. I find Scalia's reasoning here wrong on many different levels. Thom Hartmann was disgusted. RT rocks.
Apparently Scalia doesn't care what the bill says, he has his mind made up.

The Eighth Amendment prohibits cruel and unusual punishment, and the comment drew laughter.
"And do you really expect the Court to do that? Or do you expect us to give this function to our law clerks?" Scalia continued. "Is this not totally unrealistic? That we're going to go through this enormous bill item by item and decide each one?"
Justice Sonia Sotomayor, helping Kneedler along, said "What we have to look at is what Congress said was essential, correct?"
"That is correct," Kneedler said.
Justice Elena Kagan said the justices should "look at the text that's actually given (to) us." For some people, we look only at the text. It should be easy for Justice Scalia's clerks, she joked.
"I don't care whether it's easy for my clerks. I care whether it's easy for me," Scalia shot back.
