The Democratic Caucus should borrow a page from the Microsoft playbook and "embrace and extend" (see the Wikipedia entry) the DeLay Rule.
They could embrace the Republican Caucus rule allowing an indicted House leader to remain in his position.
Then extend it by allowing a convicted leader to retain their titles. The talking point would be that not only are we protecting them from "partisan prosecutors" but also "runaway juries and partisan judges"
We can make an offer to Tom Delay that when he is indicted AND convicted that he will have a welcome home in the Democratic Party.
