I'm sure you have all heard about
Bill Napoli, the South Dakota legislator, and his opinion on what might be a valid reason for an abortion. To see just how crazy this man is (he is a legislator mind you) I decided to codify his idea of the law.

After the break is what Bill Napoli's abortion law would look like.
Section 2. That chapter 22-17 be amended by adding thereto a NEW SECTION to read as follows:
No person may knowingly administer to, prescribe for, or procure for, or sell to any pregnant woman any medicine, drug, or other substance with the specific intent of causing or abetting the termination of the life of an unborn human being. No person may knowingly use or employ any instrument or procedure upon a pregnant woman with the specific intent of causing or abetting the termination of the life of an unborn human being UNLESS all of the following conditions are met:
1) The mother of the unborn human being appears before a magistrate and proves by a preponderance of the evidence that all of the following conditions have been met:
a. The mother was a virgin, i.e. had not engaged in sexual intercourse previous to the sexual intercourse which caused the conception.
b. The mother has described herself as religious. At least three witnesses must testify that the mother has attended a religious ceremony within the past 90 days OR the mother must float on water with ONE 20 pound weight attached to her person; the mother must not "paddle" or "swim" with the weight attached, she must simply float.
c. The mother testifies that she had planned not to engage in sexual intercourse until marriage. At least one self described ex-boyfriend must testify that he "did not get any" OR the mothers parents may testify that she did not have any previous romantic encounters.
d. The mother must testify that she was raped; there must be charges filed against another person, although no verdict need be reached.
e. The mother must have been sodomized, the sodomy must be as bad as you can possibly make it in the eyes of the magistrate. If the sodomy was not that bad this condition has not been met.
f. The rape of the mother must be accompanied by an aggravated assault. The aggravated assault must lead to injury.
Any violation of this section is a Class 5 felony.
