The New York Times
highlights yet another right wing attack on the Judiciary and the U.S. Constitution.
Congressional Republicans are trying to de-fund the enforcement of judicial decisions they hate.
Just a matter of time before they roll this out across the board.
Discussion below...
The Setup:
The House of Representatives took a little- noticed but dangerous swipe at the power of the courts this week. It passed an amendment to a budget bill that would bar money from being spent to enforce a federal court ruling regarding the Ten Commandments. The vote threatens the judiciary's long-acknowledged position as the final arbiter of the Constitution. It is important that this amendment be removed before the bill becomes law.
As the Times Editorial Board goes on to note, this is clearly unconstitutional under existing precedent.
The UTTER and COMPLETE disregard for the Constitution of the United States continues to astound me.
Problematically, although the substantive unconstitutionality of this kind of legislation is not debatable, Congresspeople and others have recently been having a difficult time overcoming the procedural obstacles (standing being the biggest thorn) to maintaining Constitutional litigation such as would be required here. The installment of Janice Rogers Brown, Kavanaugh and all the other "Constitution-in-Exile" whackos to the Federal appellate courts will not make this any easier. Litigation of this issue by our side will thus be costly and will require us to expend yet more resources.
Another calculated, shameful Republican abuse of our Constitution.
