I am looking for a lawyer on behalf of a blogger in New York who is facing a $3 million lawsuit for what I believe strongly is Constitutionally-protected speech.
I can't disclose many details here, but if you are in a position to offer assistance or advice, please contact me or comment. Details below ...
Here is some basic background on the case:
The blogger in question is 23 years old. He is facing a charge of defamation and $3 million suit for posting information criticizing/satirizing a local company. It's pretty clear that this was a matter of public interest, as he noted a history of unethical practices.
This information was a matter of public knowledge to begin with, as an investigative story had recently run on the local news pointing out the company's shady record.
His blog included a disclaimer stating that all writings were a matter of opinion, and even soliciting corrections/comments, saying he was willing to alter or remove anything within reason that a reader found to be in error or offensive.
He was served with a complaint without having received any warning or request to take the content down from his blog. The complaint itself contains factual errors, and Exhibit A inaccurately reproduces the blog post in question with only the first 2 (of 3) pages, hence the disclaimer is removed.
In all fairness, his post includes personal attacks on employees, crude language, and broad characterizations like "their management sucks, their staff sucks, their service sucks, their quality of work sucks." But as far as I can tell, these kinds of claims do not violate the law.
There are more details and I will add, it's not an open-and-shut free speech case. I have the defendant's permission to share and review the relevant materials with anyone who is in a position to help. Thanks.
