Provided of course democrats take the white house and expand their majorities in the House and Senate. Due to a corrupt Republican administration and cowardly caving Democrats we have two justices, Roberts and Alito, neither of whom should have even made it out of commitee let alone be appointed to the Supreme Court.
Lets do a little Review of the Supreme court before proceeding. Supreme court Justices are appointed for life and can only be removed from office by resignation or impeachment. Since it is highly doubtful either Alito or Roberts is going to resign, or do anything impeachable, we are basically stuck with them for what will most likely be a good generation or more.
This does not bode well for the future of our country. We are already beginning to see the adverse affects of the Roberts court and its not pretty. There is something we can do to stop this travesty.
We always think of the Supreme court as consisting of 9 justices. This was not always the case. Congress has the power to set the size of the court. The size of the court has varied over the many years it has been in existance from as few as six to as many as ten.

The last time it was changed was in 1869 when it was set to its current number of nine. There was an failed attempt during the FDR administration to put as many as 15 justices on the court.
Now I normally wouldn't advocate increasing the court size just to counter a pair of judges I didn't like, but the disaster of the Alito and Roberts Confirmations are an exception that need to be countered and this is the only way to do it. I think the court size should be increased to either 11 or 13 justices. We could even make it a temporary expansion only good for the terms of the justices appointed. By increasing the court size we could in essence nullify the Alito and Roberts confirmations.
