The DOL's Strategic Plan, Fiscal Years 2006-2011 (pg. 35) states: "...H-1B workers may be hired even when a qualified U.S. worker wants the job, and a U.S. worker can be displaced from the job in favor of the foreign worker."

It is despicable that companies can legally bypass the US workforce - citizens and GC holders alike for top dollar, white collar jobs. Durbin's H-1b & L-1 reform bill will prevent these ads and these recruiting practices. We need to pass this law quickly. I could not have imagined that ads such as these would be possible four decades after passage of the Equal Employment Opportunity Act.

This company required citizens from abroad to pay for visa fees, one man was required to pay $4,000. In addition, they were forced to sign employment contracts that if they didn't stay for 18 months, they would pay Vision Systems Group $1,000 for each unfulfilled month. Both are illegal in the US.
EEO inoculates the nation from this type of exploitation! Without the legal protections to bypass the US workforce, VSG couldn't have forced their workforce into these scams.
Now, the real problem is that VSG didn't even have jobs for these guys! Unemployment of H-1bs amongst offshore labor contractors is standard practice. It's simply not true that all H-1bs are working. They are tossed out for minor infractions, sit on the bench for long periods of time without pay, and depend upon sales people to get paid. But let the H-1bs tell you stories of VSG themselves.
The US Congress will not reform the H-1b corporate visa program unless they see these "H-1b Only" want ads for themselves. These ads are simply inimical to American opportunity -- and fair play. No nation can remain strong when laws allow corporations to bypass local talent.
